These Terms of Use govern access to and use of ExportWinner AI, including the website, workspace features, reports, buyer intelligence tools and related services.

1. Service

ExportWinner provides a B2B export intelligence workspace for market research, buyer discovery, lead scoring, export planning, outreach support and reporting. The service may include AI-generated content, web search results, public-source references, user-uploaded catalog data and third-party integrations.

3. No professional advice

ExportWinner is not a legal, tax, customs, accounting or financial advisor. Outputs about trade rules, customs, VAT, incentives, pricing, compliance or export costs are informational and operational drafts. Users must verify requirements with qualified professionals, public authorities, chambers of commerce, customs brokers or other official sources before acting.

4. Account responsibilities

• Users must provide accurate account and billing information.
• Users are responsible for keeping credentials secure and for activity in their workspace.
• Users must only upload, search or process data they are authorized to use.
• Users must comply with applicable export, privacy, intellectual property, anti-spam and commercial laws.

5. Acceptable use

Users may not use ExportWinner to violate laws, scrape or process data unlawfully, send spam, upload malware, infringe third-party rights, reverse engineer the service, overload systems or use generated content for deceptive, discriminatory or harmful practices.

6. AI-generated content and lead data

AI and search outputs may be incomplete, inaccurate or outdated. Lead shortlists, reports, emails, pricing estimates, policies and action plans must be reviewed by the user. ExportWinner does not guarantee that a listed company is a qualified buyer, will respond, or is suitable for the user's commercial objective.

7. Subscriptions and billing

Paid plans unlock additional limits, exports, reports, contact visibility and export intelligence modules. Subscription fees, renewal terms, cancellation rules and taxes are shown during checkout or in the billing portal. Unless required by law or stated otherwise, fees already paid are non-refundable.

Because paid access unlocks immediate research, lead data and operational export workflows, refunds are not automatic. Requests made within 14 days may be reviewed in good faith only where usage has remained limited or where a documented technical issue materially prevented normal use of the service. No automatic downgrade or refund is provided for periods already used or materially consumed.

8. User content

Users retain ownership of their uploaded catalogs, URLs, notes, lead feedback and workspace content. Users grant ExportWinner the rights needed to host, process, transmit and transform that content to provide the service.

9. Intellectual property

The ExportWinner software, interface, brand, prompts, workflows and proprietary scoring logic belong to the operator or its licensors. Users may use exported reports for their internal business purposes, subject to these terms.

10. Availability

We aim to keep the service reliable, but availability may be affected by maintenance, third-party providers, rate limits, APIs, search engines, billing systems or infrastructure incidents. The service is provided on an "as is" and "as available" basis to the maximum extent permitted by law.

11. Limitation of liability

To the maximum extent permitted by law, ExportWinner is not liable for indirect damages, lost profits, lost opportunities, failed deals, compliance mistakes, customs costs, missed incentives, inaccurate third-party data or decisions made from generated outputs.

12. Suspension and termination

We may suspend or terminate access if a user breaches these terms, creates security risk, abuses the service, fails to pay fees or violates applicable law. Users may stop using the service or cancel paid plans through the available billing flow.

13. Governing law and jurisdiction

These Terms are governed by Italian law. Unless otherwise required by mandatory law, any dispute arising out of or in connection with the use of ExportWinner AI shall be subject to the jurisdiction of the competent court of Rome, Italy.

14. Changes

We may update these Terms when the product, pricing, legal requirements or business model changes. Continued use after the effective date means acceptance of the updated terms.
